TERMS AND CONDITIONS OF CONTRACT

The Contractor
The contractor agrees to perform the work in a competent manner according to modern recognised
arboricultural practices and in compliance to the specification and quotations/estimate contained in the estimate.
 

All Contracts

All contracts and instructions are accepted on the basis of payment of full invoice price within 7 days of the date of the invoice.
 

Amendments

Amendments to the contract must be made in writing.
 

Goods and Services Tax

Where applicable GST will be charged at the current rate.
 

Complaints

Any complaints which may arise from work performed under any contract arising from acceptance of the
estimate must be made within the period of 7 days from the date of invoice, unless agreed in writing to the contrary.

Tree Preservation Orders and Conservation Areas

The trees concerned in the contract may be in a Conservation Area or be protected by a District Plan. Responsibility for all permissions
obtained from relevant authority will remain the responsibility of the owner unless ATENZ is requested to do so in this contract.
 

Private Covenants and Boundaries

Investigation of Private Covenants and Boundaries shall be the responsibility of the Owner and no liability
shall attach to the contractor for a breach of any such Covenant or Boundary.

Underground Services

Unless a plan showing the exact location of underground pipes, wires or cables has been forwarded to us by the owner of the
land (or his agent) prior to the formation of the contract the contractor shall be under no liability for any damage caused as a
result of work performed under the contract to such pipes, wires or cables, or for any damage to property resulting
therefrom and the owner of the land or his agent shall be solely liable for any such damage.

Power Lines or Telephone Cables

Any charge for the removal of power lines or telephone cables to be the responsibility of the owner, unless
otherwise agreed in writing with the contractor.

Completion of Contract

The contractor will not be liable in damages or otherwise because of non-performance of a contract arising
on account of adverse weather conditions, strikes, lockouts, war and civil commotion or lack of adequately
skilled labour due to causes beyond our control. Further, we retain the right in such circumstances to cancel
the contract in whole or in part. Completion dates shall be contingent upon weather conditions.

Expiry of Quotation

30 days after the submission of the quotation, the contractor reserves the right to withdraw and re price
work, unless otherwise agreed in writing on acceptance of instructions from the owner.

1.The quote provided covers all work to be performed by Asplundh and sets out the rates for work and the hireage of equipment. Any work over and above the quoted work will be at an extra charge and a new quote will be provided for that work.
2.Payment of all goods and services strictly 7 days following receipt of invoice /statement.
3.Method of payment by direct credit/electronic banking to the Asplundh account No: 02-0100-0555775-0. Please put name and invoice number on payment to allow us to identify the payment.
4.Asplundh stand by their work, any claims and disputes regarding the quality of the work performed by Asplundh are to be raised within 7 days of completion of the work. Asplundh will then investigate the complaint and determine if there is further work to undertake.
5.That under the terms of the privacy act (1 July 1993) that you authorise any person or company to provide us with such information as we may require in response to our credit enquiries. That you authorise us to furnish to any third party, details of this application and any subsequent dealings that you have with us as result of this application being actioned by us.
6.That you undertake to pay the account in full on or before the due date. In default of such prompt payment, you undertake to pay late payment fees of 2% per month on any amount outstanding and to indemnify us and pay all costs and expenses with we may incur recovering from you any overdue account.

Hidden Obstructions

Quotations for felling are based on the assumption of trees being free from metal, stone or other hidden obstructions. In the event of a
tree being impossible to fell in the normal way, the company reserves the right to re quote accordingly.

Stump Grinding

Stump grinding involves the removal of the tree stump to a depth of 150mm, but does not include the
removal of lateral root or stump chippings unless specified otherwise.

Site Conditions

The contract price is based on the site conditions, existing at the time of the preparation of the estimate, remaining unchanged.

Debris

All lengths mentioned are approximate.

Insurance Cover

All work carried out by the contractor is covered by $5,000,000 Third Party and Public Liability Insurance
for damage to persons or property that may result in the implementation of the contract.
